This page, together with the documents referred to on it, tells you the terms and conditions (these "Terms and Conditions") on which we supply any of the products (each a Product) listed on our website www.hamrohub.com (hereinafter referred to as the "Site") to you (the "user" or "you").

By using the Site in any manner, including but not limited to visiting or browsing the Site, you agree to be bound by these tearms and condition, including those additional terms and conditions and policies reffered to here and/or available by hyperlink. This Terms applies to all users of the Site, including without limitation users who are sellers, customers, merchants, contributors of content, information and other materials or services on the Site.

HAMROHUB MARKETPLACE

  • This page gives you the terms and conditions (the "Terms") on which you may make use of the HAMROHUB Marketplace Platform (the "Platform"). Please read these Terms carefully before ordering any Products from the Platform. By using the Platform, you indicate that you accept these Terms and that you agree to abide by them.
  • We reserve the right to change these Terms at any time without notice to you by posting changes online. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes. Your continued use of the Site after changes are posted constitutes your acceptance of the amended Terms.
  • You agree to comply at all times with any instructions for use of Marketplace which we make from time to time.
  • In these Terms:
    "Seller" refers to any merchant that has signed up with HAMROHUB Marketplace to sell their products using our platform;
    "Marketplace Product/Item" refers to any product sold by sellers through our platform.
  • The use of the Platform is subject to HAMROHUB's "Terms and Condition" and "Privacy Policy".

 

MEMBERSHIP ELIGIBILITY

  • Age: In order for you to use HAMROHUB Marketplace ("HAMROHUB"), you must be a least 18 years of age. You represent and warrant that you are at least 18 years old and that all registration information you submit is accurate and truthful. HAMROHUB may, in its sole discretion, refuse to offer access to or use of the Site to any person or entity and may change its eligibility criteria at any time without noitice to you. This provision is void where prohibited by law and the right to access the Site is revoked in such jurisdictions.
  • Compliance: You agree to comply with all local laws regarding online conduct and acceptable content. You are responsible for all applicable taxes payable as a result of your activity on the Site. In addition, you agree to abide by HAMROHUB's policies as stated in this Terms and listed below (if applicable to your activities on or use of the Site) as well as all other operating rules, policies and procedures that may be published from time to time on the Site by HAMROHUB, each of which is incorporated herein by reference and each of which may be updated by HAMROHUB from time to time without notice to you:

    In addition, some services offered through the Site may be subject to additional terms and conditions published by HAMROHUB from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into this Terms by this reference.
  • Password: Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify HAMROHUB of any unauthorised use of your password or any breach of security. You also agree that HAMROHUB cannot and will not be liable for any loss or damage arising from your failure to keep your password secure. You agree not to provide your username and/or password information to any other party other than HAMROHUB without HAMROHUB's express written permission.
  • Buyer Account Information: You must keep your account information up-to-date and accurate at all times, including a valid email and address.
  • Seller Account Infomartion: You must keep your account information up-to-date and accurate at all times, including a valid email and address. To open an Sell account in HAMROHUB you must provide and maintain a valid:
    Agent account setup is FREE
    Company need to be registered under Nepal company law.
    Product must be genuinely made in Nepal.
    Company detail info like (Company reg no, Address, Telephone No, Email Address)
    Photocopy of Company Register certificate.
    Photocopy Approval of the product by Nepal Government certificate ( optional )
    Photocopy Brand Approval by Government certificate (optional)
    Contact Personal Info (Name, Designation, Email, Phone No).
    Bank Info (Bank Name, Bank Code, Branch Code, Bank Address, Account No, Account Name)
  • Account Transfer: You may not transfer or sell your HAMROHUB account and User ID to another party. If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Terms.
  • Account Ownership: HAMROHUB SELLERS may only hold and operate one active selling account at any one time and the selling account must only be operated by the named account holder. If a secondary account is required then the SELLER must request prior written permission from HAMROHUB Marketplace. HAMROHUB Marketplace reserves the right to reject any such request and may, at its discretion, terminate additional selling accounts or selling accounts being operated by a person other than the named account holder without prior warning.
  • Feedback: Marketplace takes feedback integrity seriously. Sellers may offer small incentives for general feedback, however manipulation and/or bribery is not tolerated. This includes feedback from a related account, offering incentives/bribes in return for specific feedback. The Marketplace team reserve the right to remove any feedback which it suspects has been posted as a result of such manipulation or bribery and may close the seller account to which it relates.
  • Right to Refuse Service: HAMROHUB reserves the right to refuse service to anyone at any time. HAMROHUB's services are not available to temporarily or indefinitely suspended HAMROHUB members. HAMROHUB reserves the right, in HAMROHUB's sole discretion, to cancel unconfirmed or inactive accounts.

 

FEES AND SERVICES

  • Subscription/Registraton is FREE for Merchants ("Seller"). HAMROHUB Marketplace charges a percentage of the sale price when the item sells. HAMROHUB Marketplace's Features and Fees are subject to change, are incorporated into this Terms by reference. Increase to the Features & Fees for HAMROHUB Marketplace's services are effective after HAMROHUB Marketplace provides you with at least thirty (30) days' notice by posting the changes on the Site. However, HAMROHUB Marketplace may choose to temporarily change the Features & Fees for its services for promotional events; such changes are effective when HAMROHUB Marketplace posts the temporary promotional event on the Site. HAMROHUB Marketplace may decrease the fees as stated in the Features & Fees with no notice to you. HAMROHUB Marketplace may, at its sole discretion, change some or all of HAMROHUB Marketplace's services at any time. In the event HAMROHUB Marketplace introduces a new service, the fees for that service are effective at the launch of the new service. Unless otherwise stated, all fees are quoted in Nepalese Rupees (NRP).
  • Seller accounts must stay up-to-date with all fees owed or the account may be suspended until all outstanding fees are paid in full.
  • You are responsible for paying all fees and applicable taxes associated with using HAMROHUB Marketplace.

 

PRODUCT LISTING AND SELLING

  • Listing: By listing an item on the Site Seller ("you") warrant that you and all aspects of the item comply with HAMROHUB Marketplace's published policies. You also warrant that you may legally sell the item. You must accurately describe your item and all terms of sale in your listing. Your listings may only include text descriptions, pictures and other content relevant to the sale of that item. All items must be listed in an appropriate category with appropriate tags. If the "in stock" quantity is more than one, all items in that listing must be identical with the only exception being minor variations arising from items being hand-finished which must be included on the listing.
  • Product Pictures and description must reflect the actual product.
  • Product Pictures should be of standard size provided by hamrohub. ()
  • Product Picture quality should be good and professional take as the picture quality is the key point of sale at Hamrohub.
  • Product Price will be determine by seller.
  • Colours: While editing the images to display on Site, always strive to produce the most realistic colours of the merchandises. However, different people may perceive different colours as different devices renders colours differently. Such situations are not within our control and we cannot be held responsible for purchases made with the wrong perception of colours.
  • Measurements: All measurements provided on Site should be as accurately as possible. Seller will be responsible for those discrepancies if it is beyond the grace limit.
  • Binding Sale: All sales are binding. The seller is responsible for shipping up to the point of delivery or otherwise completing the transaction with the buyer within 20 days, unless there is an exceptional circumstance, such as: (a) the buyer fails to meet the terms of the seller's listing (such as payment method), or (b) the seller cannot authenticate the buyer's identity. The buyer is obligated to deliver appropriate payment for items purchased, unless there is an exceptional circumstance.
  • Fee Avoidance: The price stated in each item listing description must be an accurate representation of the sale. Sellers may charge reasonable shipping and handling fees to cover the costs for packaging and posting the items. Sellers may not charge excessive shipping fees or otherwise avoid fees. You may not alter the item's price after a sale for the purpose of avoiding HAMROHUB Marketplace transaction fees, misrepresent the item's location, or use another user's account without permission. Sellers may not encourage buyers to purchase an item listed on HAMROHUB Marketplace outside of the HAMROHUB Marketplace site, such as directly through PayPal. This may also constitute fee avoidance.

 

ORDERING

  • Before making an Order, you must first register for an account in accordance to the Terms and Conditions indicated on HAMROHUB Marketplace.
  • We shall not be obliged to supply Marketplace Products to you until we have accepted your Order. Unless expressly stating that we accept your order, an email, letter, fax or other Acknowledgement of your Order by us is purely for information purposes and does not constitute the Confirmation of Order. Our confirmation of Order shall be deemed to come into effect when it has been dispatched by us.
  • Without affecting your obligation to pay us earlier, we may send an invoice to you at any time after we have accepted your Order. Until the time when we accept your Order, we reserve the right to refuse to process your Order and you reserve the right to cancel your Order. If HAMROHUB, you, or the Seller has cancelled your Order before we have accepted it, then we will promptly refund any payment already made by you or your credit or debit card company to us for the order of Marketplace Product.

 

PAYMENT

  • All payments can be made to either of our three official accounts:
    1/ OCBC Current Account #####, or
    2/ paypal@hamrohub.com on PayPal.
  • For your convenience, we have made available a myriad of payment methods:
  • Via PayPal, Credit Card / Debit Card
    PayPal accepts VISA, MasterCard, Discover and American Express credit card payments online.
    A transaction fee (which we absorb) of 3.4% will be charged upon the transacted amount together with an addition of $0.50.
  • Internet Banking / Bank Transfer
    After you have made the payment transfer, please make sure to take note of all the details of the transfer before logging out of your Internet Banking system as you are required to provide those information when submitting payment details later on.
  • Submitting Payment Details

    After making the payment transfer, all required payment details must be submitted on our Site (via http://www.hamrohub.com/index.php?route=account/ibank) within 24 hours since the receipt of an invoice. This is a crucial step to completing your order hence it is important that you submit all required payment details accurately.

    We will neither be held responsible if your order is cancelled because you did not submit payment details within 24 hours since the receipt of an invoice nor if the processing of your order is delayed because of insufficient or inaccurate payment details provided on your part.

    Details required include:
    1. Internet banking nickname (only for Internet Banking)
    2. Bank account transferred to
    3. Transferred amount
    4. Transaction reference number
    5. Snapshot of successful payment transfer (optional field - recommended to fill up only for ATM Transfers)

 

SHIPPING AND DELIVERY

  • Shipping / Delivery Charge will be automatically calculated by system base on the shipping method and the destination selected by customer.
  • By default, shipping charges will be paid by the consumers.
  • HAMROHUB aims to deliver Marketplace products you ordered within the time agreed upon at purchase. However, we are unable to guarantee that all orders will be delivered within the stipulated time frame.
  • Neither we, nor the Seller, shall be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.
  • Marketplace products will be delivered in our standard packaging. Any special packaging requested by you is subject to additional charges.
  • HAMROHUB partners with reputable shipping providers to collect products from our sellers, and delivers them directly to you. Once the Seller confirms your order, they pack your item(s) and schedule a pick-up through our Seller center platform.
  • Since Marketplace products are packaged and prepared by the Sellers themselves, we are unfortunately unable to regulate and control all aspects of the order process. As such, HAMROHUB is not liable for any delays or issues that arise out of this aspect of the process. We are likewise not liable for any losses, liabilities, costs, damages, charges or expenses that result from said delays and issues.
  • For any unexpected delays in the delivery process our customer service team will notify you through email.
  • Upon delivery of the Product to you, you may be required to sign for delivery. For cash on delivery payment, you agree to pay the courier in cash prior to receiving the Product. You must inspect the Product immediately after delivery, and contact HAMROHUB Customer Service at support@hamrohub.com in case of any faults, defects or damage. You should hold on to the documents and packaging delivered with the Product.
  • Once you have received Marketplace product, both the Seller and HAMROHUB will not be liable for loss or destruction of the Product.
  • If delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within two weeks of our first attempt to deliver the Product to you) accept delivery or collect the Product from the carrier, or the carrier's inability to find your location due to erroneous address provided, then we may (without affecting any other right or remedy available to us) do either or both of the following:
    a) charge you for reasonable storage fee and other costs reasonably incurred by us; or
    b) no longer make the Product available for delivery or collection and notify you that we are immediately cancelling the applicable Contract, in which case we will refund to you or your credit or debit card company as applicable any money already paid to us under the applicable Contract, less our reasonable administration charges (including for attempting to deliver and then returning the Product, and any storage fees as provided for in clause 5.11(a) above).
  • In addition, any custom, taxes or import duties imposed by the destination country must be incurred by the recipient as we have no control over these charges.
  • If you are unable to select a shipping method while making an order, this may mean that your package is too heavy to be sent and/or your country requires a different shipping method. In such cases, do email us at support@hamrohub.com so we can better assist you.
  • If you wish to contact the Seller, this must be done through HAMROHUB by email support@hamrohub.com

 

CANCELLATION OF ORDERS

  • Cancellation by Seller:
    Seller may cancel a Order if the Product is not available for any reason. HAMROHUB will notify buyer ("you") if this is the case and return any payment that you have made.
  • Cancellation by Customer (Non-Faulty Product):
    a) If you wish to cancel your order please contact our Customer Service Team at support@hamrohub.com. Within 24 hours, No cancellation fees apply.
    b) Once an order has been dispatched it will not be cancelled.
  • HAMROHUB will usually refund any money received from you using the same method originally used by you to pay for the order.

 

FAULTY PRODUCTS

We will liaise with Sellers if a product of theirs fails to meet these standards.

  • We warrant that:
    a) the Product will be delivered undamaged in the quantities ordered; and
    b) the Product will conform with the manufacturer's latest published instructions as set out on the Site or in our Product material at the time of your Order.
  • The Product is intended to be used strictly in accordance with the manufacturer's latest published instructions as set out on the Site or as on the Product itself. It is your responsibility to ensure that you use the Product strictly in accordance with those instructions.
  • Before delivery, we may make minor adjustments to material, colour, weight, measurements, design and other features to the extent that they are reasonable.
  • We try very hard to deliver Products in excellent condition. However, if you tell us that the Product is faulty, you agree to keep the Product in its current condition available for us (or our agent) to inspect within a reasonable time.
  • In order to provide you with any remedies for a faulty Product, we may need your assistance and prompt provision of certain information regarding the Product, including:
    a) you specifying with reasonable detail the way in which it is alleged that the Product is damaged or defective; and
    b) you providing us with the delivery note number and such other information as we reasonably require.
  • If you would like us to repair, replace or provide a refund for the Product where it did conform to the applicable Contract, and we find that the Product has:
    a) been misused, abused or subjected to neglect, improper or inadequate care, carelessness, damage or abnormal conditions; or
    b) been involved in any accident or damage caused by an incorrect attempt at modification or repair; or
    c) been dealt with or used contrary to our or the manufacturer's instructions for the Product; or
    d) deteriorated through normal wear and tear,
    after delivery by us, we may at our discretion decide not to repair, replace or refund you for the Product and/or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or the payment details that you provided to us when you made your Order, and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.

 

EXCHANGE POLICY

This Exchange Policy applies only to merchandises purchased on our Site. Any merchandises purchased through third parties are not secured by this Exchange Policy.

Requests for exchanges are allowed only when you have received (i) an incorrect merchandise, or (ii) a defective merchandise. Requests for exchanges other than the above reasons will not be entertained.

Regardless of the reason of the request for exchanges, exchanges are allowed only if the merchandise in concern is (i) unworn, (ii) unwashed and in a (iii) brand new and saleable condition. Requests for exchanges will be rejected if any of the above criteria is not met.

If all of the above criteria has been met, please contact our Customer Service Team within 10 working days from when the merchandise was dispatched to request for an exchange. Requests for exchanges will not be entertained after 10 working days from when the merchandise was dispatched. All exchange cases opened (signified by the first reply from HAMROHUB) will have 30 days to be completed, HAMROHUB will not be obliged to follow up on the case on the 31st day.

All exchanges are assessed on a case-by-case basis and we reserve the right to exercise discretion in permitting or rejecting all requests for exchanges.

Incorrect Merchandises Received:
If you have received a different merchandise from what you have ordered, please send in an email to our Customer Service Team at support@hamrohub.com with the email titled "Incorrect Merchandise Received". Together with this e-mail, please provide us with your Invoice Number and a clear snapshot of the mailing envelope (with the mailing label and postage stamps in view) together with the incorrect merchandise received.

Defective Merchandises Received:
A defective merchandise is defined as an item that has stains (before washing), holes, pills, missing buttons, loose stitches or spoilt zippers at the point of receipt.

There might be discrepancies of 0.5"-1" (measured when apparel is laid flat and not stretched) between our merchandises and the measurements we have provided on our Website. As such, these discrepancies are not regarded as a defect.

If you have received a merchandise with any of the defects as stated above, please send in an email to our Customer Service Team at support@hamrohub.com with the email titled "Defective Merchandise Received". Together with this e-mail, please provide us with your Invoice Number and a clear snapshot of the defect followed by an elaboration of the defect in words.

Solution

Upon receiving your request for exchange, our Customer Service Team will assess your situation with the images attached with the email. If the merchandise is deemed as incorrect or defective upon assessment of the image, a one-for-one exchange will then be approved.

However if the defect is found not to be a manufacture defect upon assessment of the merchandise itself, we reserve the right to cancel the agreement to conduct an exchange and we will not be liable for any shipping fees incurred in this process.

Exchange for Another Merchandise

In the event whereby the originally purchased merchandise is out of stock in all colours and sizes, you will be offered an exchange for another merchandise of your choice with the same or lesser price than the originally purchased merchandise. You may choose to exchange it for another merchandise of a higher price than the originally purchased price if you are willing to make a top-up of the difference in price.

Credits or Refund

If you do not wish to exchange it for another merchandise, you can choose to store the value in your account as credits or to receive a refund.

Mode of Return

Regardless if you would like to exchange the originally purchased merchandise for another merchandise, or store the value in your account as credits or to receive a refund, you can choose to return the merchandise to us via Registered Mail once an exchange has been approved.

Registered Article

All merchandises have to be returned as a Registered Article as it is accompanied with a Registered Article Number (RA No.) which will enable us to track the location of the parcel.

If you prefer to return the merchandise to us as a Registered Article, please provide us with the RA No. immediately upon dispatchment. We will mail out the replacement to you once you have provided us with the RA No. of the incorrect or defective merchandise.

 

PAYMENT SETTLEMENT

  • Seller will receive payment 7 days after item(s) has reached the consumer and when you have reached a pre-determined threshold amount in your account. (Eg: USD $500) The amount received will be after deducting commission, transaction and shipping charges).
  • Payment will be on hold until the product reached to the customer.
  • Transaction fee (from HamroHub Bank Account to Seller Bank Account) will be beared by Seller.
  • Transaction duration differ bank to bank (in general 5-10 working days)

 

COMPLAINTS MANAGEMENT

Any complaints against Sellers should be placed through HAMROHUB Marketplace. Please contact us at: support@hamrohub.com

 

  • HAMROHUB Marketplace has several policies in place, dedicated to protecting trademarks, copyrights, and intellectual properties to the best of our abilities.
  • At HAMROHUB Marketplace, we do our best to manage the content loaded on our website, ensuring that products listed do not infringe upon copyright, trademark, or intellectual property rights of third parties. Fraudulent products are not a part of our product line-up, and action will be taken against Sellers who list them.
  • Should you have reason to believe that your rights and trademarks have been infringed upon, please contact our customer care team, and we will launch an investigation into the matter.

 

PRIVACY

  • Except as provided in HAMROHUB Marketplace's Privacy Policy HAMROHUB Marketplace will not sell or disclose your personal information (as defined in the Privacy Policy) to third parties without your explicit consent.

 

CONTENT

  • Any content uploaded to HAMROHUB Marketplace automatically grants us an irrevocable, perpetual, and royalty-free right to make use of it in any way we deem acceptable, on any platform of media.
  • The rights to any content uploaded to HAMROHUB Marketplace MUST be owned by you when it is uploaded. Should a complaint pertaining to content you have uploaded be filed, you agree to take full responsibility in addressing the complaint, and to pay for any damages incurred by copyright, trademark, and intellectual property infringements.

 

LIABILITY

  • HAMROHUB Marketplace is not liable for any losses, potential or otherwise, incurred as a result of HAMROHUB or other users' taking actions described in the Terms & Conditions, Privacy Policy, and Copyright Policy. This is including, but not limited to items listed, comments posted, disposal or damage of items suspected to be fraudulent, or any legal actions.
  • While we do vet and assess sellers before allowing them to sell on HAMROHUB Marketplace, not every individual item and product piece passes through our hands for quality assessment before being delivered to you, the customer. Therefore, we are unable to completely guarantee the authenticity and accuracy of listings without a small margin of error. You can, though, be assured that any and all sellers and products have to undergo a review and training process that is in place to ensure the highest quality of goods and services provided.
  • HAMROHUB Marketplace, its affiliates, employees, staff, directors, agents, and advocates are not liable to you for any losses, potential or otherwise, that result from circumstances that are unforeseeable to any degree, directly or indirectly stemming from your inability to access or make use of our Site and services.
  • HAMROHUB Marketplace does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside HAMROHUB Marketplace's control or otherwise.

 

ACCESS AND USAGE

  • In using our website, you agree to not make use of any automated program or means (including but not limited to crawlers, robots, scrapers, bots or tools) to access our site without a written agreement on our part expressly allowing you to do so. Any such agreement, if provided, is non-transferable, and cannot be extended to include any other party. Information and content hosted on our website is owned and licensed to HAMROHUB Marketplace.
  • You agree that you will not copy, reproduce, or modify existing content on our website without written permission from HAMROHUB Marketplace, nor will you take any action that either directly or indirectly results in an unreasonable or disproportionately large load on our servers and infrastructure.
  • You also agree to not make any attempt to interfere with our website, operations, or their workings, including circumventing any measures we have in place to restrict access to our site.
